Resumen
El trabajo analiza las recientes tendencias en la utilización de algunas figuras, alternativas a la clásica propiedad, como cauce para la consecución del derecho constitucional a la vivienda. Estas tendencias se encuentran en determinadas medidas legislativas o reglamentarias, en actuaciones de las Administraciones públicas, así como en el propio mercado. Se han escogido las que se refieren al arrendamiento, –que se traducen en un fortalecimiento de la posición del arrendador–, y al derecho de superficie. Todo ello, a la luz del principio informador contenido en el art. 47 CE y en el marco de la coyuntura económica actual, que provoca, quizá de forma no buscada, el relanzamiento de opciones poco utilizadas

Abstract
This paper conducts an analysis of some of the recent trends in the use
of certain figures institutions, alternatives to the real state property, as
means for achieving the constitutional right to housing. These trends can
be found in some statutes and bye-laws, in proceedings of Public
Administrations, and in the market itself. The focus of attention is the lease,
resulting in a strengthening of the position of the lessor, and the real right
in the surface of the land. All this, in light of the principle contained in
Article 47 EC and under current economic conditions, leading, perhaps
unintended way, the revival of hitherto little-used options such as leasepurchase
price applicable to housing.
