Resumen
En el presente trabajo se analiza el tema del conflicto entre la libertad de creación literaria y el derecho a la intimidad. Se sostiene que el autor de una obra de ficción puede basarse en personajes reales, pero se afirma también la exigencia de que el escritor respete el derecho a la intimidad de aquéllos. Se considera que la clave para decidir si una obra vulnera el derecho a la intimidad hay que encontrarla en el hecho de si un lector medio puede, o no, llegar a entender que los acontecimientos que se relatan son reales, con independencia de que, efectivamente, lo sean, y que los mismos se refieren a una persona claramente identificable (bien por haberse usado su nombre, bien por haberse descrito por sus rasgos y circunstancias personales). Se presta atención a la posibilidad que tiene el escritor de inspirarse en procesos penales célebres, proponiéndose criterios

Abstract
This paper analyses the conflict between the freedom of literary creation and the right to privacy. It holds that a work of fiction may have been based on a real person, but it also affirms the obligation of the writer to respect their privacy. It considers that the key to decide if the work offends the right to privacy is to be found in whether the average reader could believe that the story told is real, regardless of whether in fact it is, and if the story refers to a clearly identifiable person (either by using a name or having described physical features or personal circumstances). Attention is paid to the possibility that the writer may have been inspired by an important criminal trial, and proposes criteria to harmonize the freedom of artistic creation with the so-called criminal’s «right to be left in peace».
