Resumen
Este trabajo pretende identificar los pronunciamientos de la Corte Suprema de Justicia de la Nación argentina sobre protección del patrimonio cultural de las comunidades indígenas en la órbita del derecho constitucional al ambiente sano. Tal derecho ha sido reconocido en el art. 41 de la Constitución nacional, que además establece el deber de preservar el patrimonio natural y cultural enmarcado en el desarrollo sostenible, el que reclama la satisfacción del crecimiento económico y las necesidades actuales sin comprometer los recursos y capacidades de las generaciones futuras. El alcance del patrimonio cultural se ha modificado. Es entendido ahora como la representación de una identidad colectiva y de su desarrollo histórico, significado reconocido por la jurisprudencia de la corte argentina en el ámbito de la protección del ambiente y del respeto a la preexistencia étnica y cultural

Abstract
This paper aims to identify the pronouncements of the Supreme Court of Justice of the Argentine Nation on the protection of the cultural heritage of indigenous communities within the orbit of the constitutional right to a healthy environment. This right has been recognized in Article 41 of the National Constitution, which also establishes the duty to preserve the natural and cultural heritage within the framework of sustainable development, which calls for the satisfaction of economic growth and current needs without compromising the resources and capacities of future generations. The scope of cultural heritage has been modified. It is now understood as the representation of a collective identity and its historical development, a meaning recognized by the jurisprudence of the Argentine Court in the field of environmental protection and respect for ethnic and cultural pre-existence.
