Resumen
En España, hasta la sentencia del Tribunal Supremo de 4 de noviembre de 2008 se prohibía la cuota litis en sentido estricto. En realidad, no se prohibía cobrar a los abogados por los resultados obtenidos, sino cobrar sólo por resultados, sin derecho a pactar la no percepción de honorarios si se perdía el pleito. En la actualidad tal prohibición ha sido declarada sin cobertura legal por vulnerar en esencia la libre competencia, al impedir que los precios se fijen libremente mediante negociación entre abogado y cliente.

Abstract
Earnings based on a no-win-no-fee basis were forbidden in Spain up until the sentence of Spain’s High Court on 4th November 2008. Charging fees for winning a case was not what was forbidden; instead, what was forbidden was to charge only if the case was won, as there was no right to agree to not charging a fee if the case was lost. Currently, there is no law that forbids that prohibition, as it infringes the free competition between lawyers.
