Resumen
El artículo analiza los perfiles y desafíos actuales y prospectivos del Estado de Derecho, entre los que se cuentan, el mantenimiento de un real sistema democrático, la existencia de una Constitución suprema y con fuerza normativa al igual que los instrumentos internacionales básicos en materia de derechos humanos, y el respeto y la realización de los derechos fundamentales sin superfluas distinciones categoriales, que pueda dejar fuera de la cobertura protectoria a los derechos económicos, sociales y culturales o a los derechos colectivos o de incidencia colectiva. Para ello se precisa de una Justicia Constitucional activa, independiente, valerosa y legitimada socialmente, pero al mismo tiempo, prudente, reflexiva, equilibrada y consciente de sus límites.

Abstract
This paper analyses the profiles and current and prospective challenges of the Rule of Law, among which are counted the maintenance of a real democratic system, the existence of a supreme Constitution with normative force as the core international instruments on human rights, and the respect and realization of fundamental rights without unnecessary categorical distinctions that can be left out of protectoral coverage to economic, social and cultural rights or collective (or collective impact) rights. This requires a Constitutional Justice active, independent, courageous and socially legitimated, but at the same time, prudent, thoughtful, balanced and aware of its limits.
