Resumen
Comenzamos el presente trabajo aludiendo a una decisión del Tribunal
Constitucional en la que se rechaza que el matrimonio gitano pueda producir
los mismos efectos que otras confesiones y explicando las razones. El artículo
revisa alguno de los principales problemas que ha generado el actual
modelo de regulación del matrimonio en España. En la actualidad, el Código
Civil reconoce varias formas, algunas de ellas religiosas, entre las que los
ciudadanos pueden elegir. Pero ¿cuál es el significado del matrimonio en la
sociedad española actual? El trabajo trata de explicar, en primer lugar, los diferentes
problemas que se han sucedido en el Derecho matrimonial español
en las últimas dos décadas del siglo veinte, explicando cómo matrimonio y
familia son concebidos hoy desde otra perspectiva que demanda otro modelo
de regulación. La evolución de la sociedad española requiere una reforma
en orden a evitar los inconvenientes que aquí exponemos. Es necesario
proponer otras vías o soluciones más acordes con el contexto social.

Abstract
At the beginning the present work comments a decision of Spanish Constitutional
Court that doesn’t accept that gipsy marriage rituals have the
same effects than others confesions, and we explain why. This article reviews
some of the main problems caused by the actual model of regulating the marriage in Spain. Actually, Civil Code recognizes various forms, some
of them religious, citizens may elect. But, what is the meaning of marriage
in Spanish society at the present time? Spanish marriage´s model must be
reformed because actually marriage and family are understood front a
different point of view that requires another model of regulating. This article
tries in a first instance to explain the different problems have arisen
through the last two decades of XXTh Century. Most of them are still not
resolved. The evolution of Spanish society requires a reform in order to
eliminate the adverse effects and contradictions that cannot be explained.
