Resumen
La concurrencia de atribuciones en materia de competencia entre las autoridades horizontales de defensa de la competencia y los organismos reguladores sectoriales ha provocado en los últimos años no pocos problemas de coordinación, que han llegado incluso a poner en cuestión la unidad del sistema de defensa de la competencia. En este sentido, no han sido infrecuentes las ocasiones en que los reguladores sectoriales y el TDC han adoptado decisiones contradictorias entre sí a la hora de enjuiciar (en paralelo) conductas de dudosa compatibilidad con las exigencias de la libre competencia. La Ley 15/2007, de 3 de julio, de Defensa de la Competencia, incorpora mecanismos de coordinación entre la nueva Comisión
Nacional de la Competencia y los reguladores sectoriales para prevenir tales situaciones.
El presente artículo tiene por objeto el examen de dichos mecanismos.

Abstract
The concurrence of authorities entrusted with the enforcement of Spanish Competition
Law (competition authorities and regulatory authorities) has provoked, in the past years,
important coordination issues that have even questioned the unity of the Spanish
competition system. Indeed, it has not been infrequent that regulatory and competition
authorities have adopted contradictory decisions when assessing, in parallel, conducts of
uncertain compatibility with the principles of open competition. The recently adopted
Spanish Competition Act has introduced coordination mechanisms between the newlycreated
Spanish Competition Authority (Comisión Nacional de la Competencia) and regulatory authorities aimed at preventing such ambiguous situations. The aim of this
paper is to analyse these coordination mechanisms.
