Resumen
Este artículo examina la posición constitucional de la Comisión dentro de la Unión y, en particular, explora algunos de sus poderes fundamentales a la luz de la jurisprudencia más reciente del Tribunal de Justicia. A caballo entre la tecnocracia y la política, y sin corresponder sus funciones a las que tradicionalmente ejerce el poder ejecutivo a nivel nacional, examinaremos brevemente su evolución, así como los debates sobre su legitimidad. Tras explorar más en particular tres aspectos de su acción: su poder de iniciativa, su poder de desarrollo normativo y de ejecución, y su poder en la acción exterior, intentaremos sacar algunas conclusiones.

Abstract
This article examines the constitutional position of the Commission within the Union and, in particular, explores some of its fundamental powers in the light of the most recent case law of the Court of Justice. Halfway between technocracy and politics, and without corresponding its functions to those traditionally exercised by the executive power at the national level, we will briefly examine its evolution, as well as the debates on its legitimacy. After exploring more particularly three aspects of its powers: its power of initiative, its power of normative development and of implementation, and its power in the external action, we will try to draw some conclusions.
